Jonathan Tofilon is a partner in the firm’s Geneva office. He focuses his practice on civil litigation, specifically within the areas of products liability, wrongful death, food contamination and recalls, construction defect litigation, and catastrophic losses. He is retained by many of the world’s leading carriers immediately following losses to control expert retention, scene investigation, and evidence preservation in order to lay the foundation necessary for successful litigation. Mr. Tofilon has successfully litigated and resolved hundreds of cases throughout the country from inception through trial and final appeal.
Mr. Tofilon has achieved a remarkable record of success in his litigation career, including numerous landmark victories and early resolutions of complex disputes. Recognized for his ability to simplify complexity with clear communication, Mr. Tofilon has substantial expertise in developing and communicating compelling legal arguments in class actions, mass-actions, consolidated actions, MDL litigation, and civil appeals throughout the United States. He is regularly retained as consulting and appellate counsel to reframe and focus the trial record into a winning appellate strategy. As part of his practice, Mr. Tofilon works with nationally recognized experts across multiple scientific disciplines, including fire origin and cause, fire spread, and fire protection, as well as mechanical, safety, food safety, auto, material, product design, human factors, and electrical engineering issues.
Mr. Tofilon is a frequent speaker and teacher on best practices and legal developments in the fields of subrogation and liability defense for insurance carriers. Because of his education and background in the business world, his litigation clients highly value Mr. Tofilon’s focus on long-term strategy and maintaining integrity in legal disputes, consistently realigning and refocusing litigation to the strategic goals of his business clients.
Prior to joining the firm, Mr. Tofilon clerked for the Honorable Judith M. Brawka, Sixteenth Judicial Circuit of Illinois and the Honorable Phillip G. Reinhard, U.S. District Court, Northern District of Illinois. Mr. Tofilon serves as the President of the Board of Directors for Administer Justice, a pro bono law firm serving the indigent in Kane and DuPage counties.
